§ 1 Scope of Application

1.1 These General Terms and Conditions (hereinafter “GTC”) apply to all contracts for the purchase of vouchers via the online shop at koza-restaurant.de between Koza Gang GmbH & Co KG (hereinafter “Seller”) and the Customer.

1.2 Deviating, conflicting, or supplementary general terms and conditions of the Customer shall not become part of the contract unless their validity is expressly agreed to in writing.


§ 2 Subject Matter of the Contract

2.1 The subject matter of the contract is exclusively the sale of value vouchers for the KOZA restaurants in Hassloch and Landau.

2.2 The vouchers entitle the holder exclusively to redemption at the KOZA branches in Hassloch and Landau. Redemption at other branches (e.g., Speyer) or at other locations is expressly excluded.


§ 3 Conclusion of Contract

3.1 The presentation of vouchers in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.

3.2 By clicking the “Complete Purchase” button, the Customer submits a binding offer to purchase the voucher.

3.3 The Seller confirms receipt of the order immediately by email. This confirmation of receipt does not yet constitute acceptance of the contractual offer.

3.4 A contract is only concluded upon the Seller’s declaration of acceptance, which is made in the form of a separate order confirmation or by sending the voucher.


§ 4 Prices and Payment Terms

4.1 All prices include statutory value-added tax.

4.2 Payment is made via the payment methods offered in the online shop.

4.3 The voucher value corresponds to the amount selected and paid by the Customer.


§ 5 Delivery

5.1 Vouchers are sent by email as a PDF document or in physical form by post to the address provided by the Customer.

5.2 The delivery time is usually 1-3 working days after receipt of payment.


§ 6 Validity and Redemption of Vouchers

6.1 The vouchers are valid for a limited period of time from the date of purchase. This period is specified in the product description. The expiration date is noted on the voucher.

6.2 The vouchers can only be redeemed at KOZA restaurants in Hassloch and Landau. Redemption at the Speyer branch or at other locations is not possible.

6.3 The voucher can be split across multiple visits as long as a remaining balance exists.

6.4 Cash payment of the voucher value or any remaining balance is excluded.

6.5 Redemption is only possible upon presentation of the original voucher (physical or digital).

6.6 The voucher is transferable and can be given to third parties.


§ 7 Exclusion of Right of Withdrawal, Exchange, and Cancellation

7.1 In accordance with § 312g para. 2 no. 9 BGB (German Civil Code), there is no statutory right of withdrawal for vouchers.

7.2 Cancellation of vouchers already purchased is excluded.

7.3 Exchange of vouchers is not possible.

7.4 In the case of demonstrably defective or illegible vouchers, a replacement will be issued after verification by the Seller.


§ 8 Loss and Theft

8.1 In case of loss, theft, or damage to the voucher, there is no entitlement to replacement or reissuance.

8.2 The Customer is responsible for the safe custody of the voucher.


§ 9 Liability

9.1 The Seller is liable without limitation for intent and gross negligence as well as for injury to life, body, or health.

9.2 In cases of slight negligence, the Seller is only liable for breach of essential contractual obligations (cardinal obligations). In this case, liability is limited to the contract-typical, foreseeable damage.

9.3 The limitations of liability do not apply in cases of fraudulent concealment of defects or assumption of a guarantee.


§ 10 Data Protection

10.1 The processing of personal data is carried out in accordance with applicable data protection regulations, in particular the GDPR.

§ 11 Dispute Resolution

11.1 The European Commission provides a platform for online dispute resolution (ODR), which can be accessed at http://ec.europa.eu/odr.

11.2 The Seller is not obligated and not willing to participate in a dispute resolution procedure before a consumer arbitration board.


§ 12 Severability Clause

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid regulation that comes closest to the economic purpose of the invalid provision.


§ 13 Applicable Law and Jurisdiction

13.1 The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

13.2 The place of jurisdiction for all disputes arising from this contract shall be, insofar as the Customer is a merchant, a legal entity under public law, or a special fund under public law, the registered office of the Seller.
